GDMB Enterprises Ltd ANTI-SPAM POLICY

GDMB Enterprises Ltd is committed to permission-based email marketing practices, and has instituted the following zero-tolerance Anti-Spam Policy. GDMB Enterprises Ltd reserves the right to amend this Anti-Spam Policy as it deems necessary, and the amended Anti-Spam Policy will be updated and posted.
GDMB Enterprises Ltd makes reasonable commercial efforts to conform to the Federal Trade Commission’s CanSpam Act. Accordingly, GDMB Enterprises Ltd expressly prohibits the promotion and marketing of any gaming merchant within its Affiliate Program by the transmission, distribution or delivery of any unsolicited bulk or unsolicited commercial email (“Spam”). Under no circumstances may an Affiliate deliver Spam or cause Spam to be delivered to any player or prospective player.
In addition, email sent, or caused to be sent, by an Affiliate may not:
Use or contain invalid or forged headers;
Use or contain invalid or non-existent domain names;
Employ any technique to otherwise misrepresent, hide or obscure any information identifying the point of origin or the transmission path;
Use other means of deceptive addressing;
Use a third party’s Internet domain name, or be relayed from or through a third party’s equipment, without permission of the third party and GDMB Enterprises Ltd;
Contain false or misleading information in the subject line or otherwise contain false or misleading content;
Fail to comply with additional technical standards described below; and
Otherwise violate any provision in the GDMB Enterprises Ltd Affiliate Program Terms and Conditions, which are incorporated herein by reference.
Affiliates must also comply with the following:
Emails must be sent from valid email addresses that must be and remain active for a minimum of thirty (30) days from the date the email(s) is sent;
The “From” line should be from you and/or your business and not a sales pitch or marketing technique;
Emails that are solicitations or advertisements must contain clear and conspicuous identification that the email is a solicitation or advertisement;
All Affiliates sending emails must have a physical mailing address supplied in the email;
All emails must be for a targeted email list; and
All emails must be supplied with a clear and conspicuous opt-out message in the header of the email. All requests to opt-out must be honored within 10 days and the recipient who has opted-out may not be contacted via email again.
GDMB Enterprises Ltd does not authorize the harvesting or mining of personal email addresses or other personal information information, as the foregoing constitute GDMB Enterprises Ltd’s confidential and proprietary information. Affiliates are also subject to the GDMB Enterprises Ltd Privacy Statement.
Each violation of the above provisions is subject to fine up to a maximum of US$10,000. Deceptive commercial email is also subject to laws banning false and misleading advertising. Furthermore, the Department of Justice is allowed to seek criminal penalties, including imprisonment, against senders of commercial emails that fail to adhere to (or conspire to violate) the provisions set forth in this Anti-Spam Policy.
You expressly understand and acknowledge that failure to adhere to this Anti-Spam Policy shall subject you to such actions as GDMB Enterprises Ltd, in its sole discretion, deems appropriate including, without limitation: (i) the voiding of any Affiliate earnings to which you may/are otherwise entitled, (ii) the termination of your Affiliate status, (iii) the imposition of fines, and/or (iii) the reimbursements for damages and expenses which GDMB Enterprises Ltd or its clients may incur as a result of your conduct.
GDMB Enterprises Ltd’s failure to enforce this policy in every instance does not amount to a waiver of GDMB Enterprises Ltd's rights hereunder.
